Landlord & Tenant

What are my rights here?

Landlord-tenant proceedings in New York move on strict timelines and the paperwork is unforgiving — a defective notice can end a case before the merits are ever reached. That cuts both ways, and which way it cuts usually depends on who moved carefully first.

Nonpayment versus holdover: the two New York eviction routes Which case are you actually bringing? Why do you want them out? They owe rentNonpayment proceedingNeeds a 14-day written rent demand firstAny other reasonHoldover proceedingNeeds a 30, 60 or 90-day noticePetition filed with the courtOnly a marshal, on a warrant, removes anyone
The notice you serve is decided before anything else, and serving the wrong one ends the case regardless of the merits. Both routes end in the same place: a court-issued warrant, executed by a marshal. Never by the landlord.

What this covers

  • Non-payment and holdover proceedings
  • Notices — service, defects, and the consequences of both
  • Commercial lease disputes
  • Warranty of habitability claims
  • Lease negotiation

When it is worth a call

  • You have received a notice to quit or a petition
  • A tenant has stopped paying
  • You need to serve a notice and want it done correctly the first time

I trust Mitch to handle all of my real estate transactions as my Of Counsel and he always comes through and often produces results I never imagined.

Oshrie ZakFounder & Managing Member, Zak Law Group
General Counsel

I found Mitch when he jumped on a conference call that my boss and I were on with the landlord and his attorney for a prospective new location. Within minutes, he cut through all the BS and uncovered a treacherous situation we almost walked into. Immediately after the call, I told my boss, "We need this guy as our General Counsel." The rest is history.
